Student Visas 

 

New Points-Based System : Applications on or after 6 April 2010

 

(A) There are two students categories in Tier 4 of the points-based system:- 

 

1.       General Students - for students coming to the United Kingdom for the post-  16 education.

2.       Child Students - for children between 4 and 17 years old to come to the United Kingdom for their education. Children between 4 and 15 years old may only be educated at independent fee paying schools.

 

(B) Students must meet the full requirements of the Immigration Rules and have 40 points in total as shown in the table below:

 

Points required: 40

Having a valid Confirmation of Acceptance for Studies from a Tier 4 sponsor

30 points

Having enough money to cover course fees and monthly living costs (also known as maintenance or funds)

10 points

 

 

(C) A student's application under Tier 4 can be refused under the general grounds for refusal listed in the Immigration Rules. This means that even if a student meets the requirements of the category they are applying for, there may be other reasons why Home Office will refuse the application. For example, this could be because of the student’s previous immigration history. Further information about general grounds for refusal can be found on Home Office's website at:

(D) All students making a Tier 4 application will have to submit his/her biometrics details. An application can only be assessed once these are received.

 

(E)  For international students holding Adult Student Visa (Tier 4 (General)) ,  during your stay, you will be allowed to:

 

     ·        work part-time (up to 20 hours per week) during term-time;

·           work full-time during vacations;

·          do a work placement as part of your course;

·          work as a postgraduate doctor or dentist (if your course of study is a  recognised Foundation Programme); and

·           be a student union sabbatical officer for up to two years.

Tier 1 (Post-Study Work) : Applications on or after 6 April 2010

 

(A) Successful applicants in the Tier 1 (Post-Study Work) category will receive a single grant of leave for two years.

 

(B) Successful applicants will be free to seek employment without having a sponsor for the duration of their Tier 1 (Post-Study Work) leave.

Tier 5 - Youth Mobility Scheme

 

(A) You can apply if you:

·          are a citizen of a country taking part in the scheme (Australia, Canada, Japan, New Zealand or Monaco) or a British overseas citizen, British overseas  territories citizen or a British national (overseas);

·           are 18 years old or over when your visa lets you come to the United Kingdom (becomes valid) and under  31 years old when you apply;

·           have £1,600 in available maintenance (funds) when you apply .

Statement on Foreign Student Visas (Changes Starting from April 2012)

 

The Home Secretary delivered this statement to the house on 21 March 2011. References of a political nature have been removed.

 

From  April 2012 :-

 

From April 2012 all institutions wanting to sponsor students will have to be classed as 'highly trusted sponsors' and become accredited by statutory education inspection bodies by the end of 2012;

 

►English Level - Those coming to study at degree level will have to speak English at an upper intermediate level.  Others will have to speak English at an intermediate level;

 

►UKBA officers will be given the discretion to refuse entry to students who can't speak English without an interpreter and who do not meet the required minimum standards.

 

►Students at universities and publicly funded further education colleges will retain current work rights but all other students will have no right to work;

 

The 'post study work route', which allowed students two years to seek employment after their course ended, will close;

 

Meanwhile, only postgraduate students at universities and government sponsored students to be will be able to bring their family members with them;

 

►The overall time that can be spent on a student visa will be limited to three years at lower levels, as now, and five years at higher levels. There is currently no limit for study at or above degree level.
